Terms and Conditions of Sale
Applicable to sales made on mlgfood.com — version of 21 October 2026.
1. Seller
These terms and conditions govern the sales concluded by Smartvision SARL (VAT LU34034408), whose registered office is located at 278 route d'Esch, L-1471 Luxembourg, Luxembourg, hereinafter "MLG FOOD", a wholesaler of food products and beverages for professionals. Full contact details appear in the legal notice.
2. Professional customers only
The site is reserved for professional buyers (retailers, catering businesses, wholesalers, public institutions) acting for the purposes of their activity. It is not intended for consumers: the provisions of the Code of Economic Law specific to consumers, including the right of withdrawal, do not apply.
Access to the catalogue and prices requires a customer account, opened after review of an application (name, VAT number, activity). MLG FOOD remains free to accept or refuse an application. The customer is responsible for the confidentiality of their login details.
3. Shipments
MLG FOOD sells delivered goods. To reduce transport costs, the orders of several customers may be delivered in a single shipment, presented on the site as an "open order". The customer purchases products; they purchase neither transport nor loading space.
An on-demand shipment departs once it reaches a sufficient fill level (in principle 70 %) and the departure is confirmed. An order that exceeds the capacity of a shipment may be split over several deliveries; the customer is informed of this when ordering. Some shipments are regular (fixed days and order cut-off time): their delivery date is then known from the time of ordering.
4. Price
Prices are expressed in euros, exclusive of VAT, and include delivery to the chosen point. They may vary according to the delivery point. Applicable VAT is added to the order; an intra-Community supply to a taxable customer identified in another Member State is invoiced exclusive of VAT (reverse charge), subject to the validity of their VAT number.
The price displayed at the time of ordering is guaranteed for that order, even if the catalogue price subsequently changes.
Products sold by the kilo (seafood products in particular) are ordered based on an estimated weight and invoiced according to the weight actually delivered, at the agreed price per kilo. Any difference from the amount paid is the subject of a credit note or an additional charge on the invoice.
5. Order and payment
The contents of the basket are reserved for a short period (approximately 20 minutes). The order is concluded when the customer confirms it; they then receive, on screen and by e-mail, the bank transfer details: amount, IBAN and structured reference to be reproduced exactly.
Payment is made by instant bank transfer, in a single payment for the entire basket. If the transfer is not received within 2 hours of confirmation, the order is automatically cancelled and the quantities are made available again to other customers. A transfer received after cancellation is refunded.
6. Delivery
The goods are delivered to the collection point chosen by the customer, where they collect it, or to their address where the point offers this option. The delivery date is communicated as soon as it is confirmed; as long as a shipment is not confirmed, no date is guaranteed.
Transport is entrusted to a professional carrier, a subcontractor of MLG FOOD. Delivery times are given in good faith; a delay may only give rise to cancellation or compensation if it exceeds 48 hours after the confirmed date.
Risk transfers to the customer upon handover of the goods, at the collection point or at their address. The customer (or their representative) must be present or collect the goods within the time slot of the collection point; fresh products not collected cannot be kept beyond that time.
7. Unavailable product
Fresh products depend on incoming supplies. If an ordered product proves to be unavailable or available in a lesser quantity, MLG FOOD informs the customer and refunds the part not delivered, without any further compensation.
8. Cancellation of a shipment
If a shipment cannot depart (insufficient fill level, no carrier available, force majeure), MLG FOOD may cancel the orders it comprises. The customer is informed and fully refunded within 5 working days, without any further compensation.
The customer may not cancel a paid order, except with the written agreement of MLG FOOD.
9. Receipt and complaints
The customer checks the goods upon receipt (quantities, condition, temperature of fresh products). Any reservation is noted on the delivery document and confirmed in writing to contact@mlgfood.com within 24 hours, and the same day for fresh products, supported by photos. After this period, the goods are deemed accepted.
10. Traceability, labelling and storage
Products are tracked by batch. The mandatory information (name, scientific name and catch area for seafood products, allergens, use-by date or best-before date) accompanies the goods. The customer complies with the cold chain and storage conditions from the moment of handover.
11. Liability and force majeure
MLG FOOD's liability is limited to the price of the goods concerned and excludes indirect damages (loss of turnover, loss of customers). MLG FOOD is not liable for non-performance due to a case of force majeure (adverse weather, strikes, road closures, administrative decisions, failure of a supplier or the carrier beyond its control).
12. Personal data
Data is processed in accordance with the privacy policy.
13. Applicable law and disputes
These terms and conditions are governed by Belgian law. Any dispute falls within the exclusive jurisdiction of the courts of the judicial district of Brussels. Only the French version is authentic; the customer's general purchase conditions do not apply, except with the written agreement of MLG FOOD.
